An Important Note about Children
If you are under 18 years old, you can not place orders with webRetail.

Should webRetail suffer any damage or other losses as a result of a transaction entered into by a minor, we reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order/s to be placed with webRetail.

Communication
As a condition of purchase from us, we reserve the right to email you product alerts and special offers that we believe may be of interest to you. We respect your right not to receive these communications and if you advise us at the time of placing your order that you do not wish to receive these special offer and alert emails we will disable that functionality on your account. Each and every one of these communications will contain a clear link to Unsubscribe. We assure you that once you have unsubscribed, we will immediately remove your name from the communication list and you will no longer receive these special offers and alerts.

Australian Sales Only
We only sell and ship products within Australia. We will not make deliveries outside of Australia.

Purchases include GST unless otherwise stated on a product listing.

All prices are in Australian dollars (AUD).

Correction of Errors and Inaccuracies
Whilst we make every reasonable effort to present accurate information on this website, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We also reserve the right to limit quantities even after you have submitted your order.

Delivery Of Your Products
Information contained on the webRetail website constitutes an invitation to treat. No information on our website should be deemed as an offer by us to supply any Products, however webRetail will make every effort to supply Products to you.

We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email, however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card fraud.

We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.

Delivery time takes up to 14 working days from the date your payment is received. Estimated delivery times will be displayed at checkout for your Product.

We make every effort to deliver your Product according to the estimated delivery times provided by webRetail at checkout. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays. We will use our reasonable efforts to deliver your Products to you within the estimated delivery time, however we do not guarantee that we will deliver within this timeframe. Title and risk of loss to all Products will pass to you on delivery.

Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us.

We encourage you to visit the “My Account” section on our website to view the delivery status of your Products.

Delivery will be via Australian Post and customers will need to provide a daytime delivery address such as a work address and a contact phone number including the area code. Please ensure that someone will be available to sign for the parcel. If delivery is unsuccessful and the delivery address is in NSW or QLD, our courier will leave a calling card with advice for the recipient to collect the parcel from their local Post Office. This convenient service is provided to you at no extra charge. In all other states, our courier will leave a calling card asking the recipient to contact them directly to arrange for re-delivery (again at no extra charge). In all cases, if the parcel is not received within 7 business days it will be returned to us but additional delivery charges will apply.

Indemnification
The customer agrees that it shall defend, indemnify, save and hold webRetail harmless from any and all demands, liabilities, losses, costs and claims, including legal costs claimed or asserted against webRetail, its agents, its customers, its employees, that may arise or result from any service provided or omitted, performed or agreed to be performed or any product sold by customer, its agents or employees.

The customer agrees to defend, indemnify and hold harmless webRetail against liabilities arising out of:

• any injury to person or property caused by any products sold or otherwise distributed in connection with the webRetail website.
• any material supplied by customers infringing or allegedly infringing on the proprietary rights of a third party.
• copyright infringement
• any defective products sold to customer from the webRetail website
• any defamatory or allegedly defamatory material on webRetail servers

Disclaimer
webRetail will not be responsible for any damage, loss or liability that the customer or any third party may suffer. We make no warranties of any kind, expressed or implied for services we provide. webRetail disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery and any and all service interruptions caused by webRetail and its employees or otherwise. webRetail reserves the right to revise its policies at any time.

Miscellaneous
These Terms and Conditions will be binding upon each party in accordance with the laws of New South Wales. These Terms and Conditions will not be assignable or transferable by you without the prior written consent of www.webretail.com.au. These Terms and Conditions contain the entire understanding of the parties regarding its subject matter. No failure or delay by a party in exercising any right, power or privilege under these Terms and Conditions will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other such right, power or privilege. The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision of these Terms and Conditions, all of which will remain in full effect.
